(Request a copy)Während die Strafrechtliche Abteilung den einzelnen Staatsanwaltschaften die Beschwerdelegitimation zur Erhebung von Beschwerden in Strafsachen abspricht, hält die Erste öffentlich-rechtliche Abteilung ihrerseits mit Nachdruck an deren Beschwerdelegitimation fest. Die Rechtsprechung der Strafrechtlichen Abteilung schafft praktische Probleme und verletzt die kantonale Organisationsautonomie.
