Im Juni 2020 wurde eine parlamentarische Initiative mit dem Ziel der Schaffung eines Cybermobbing-Tatbestands im schweizerischen Strafrecht eingereicht. Dieser Beitrag geht daher der Frage nach, wie diese Forderung zu beurteilen ist. Dabei wird einerseits die geltende Rechtslage beleuchtet sowie andererseits ein Blick über die Grenzen in Nachbarrechtsordnungen geworfen. Abschliessend erfolgt eine Stellungnahme zum Reformbedarf im schweizerischen Strafrecht bezüglich Cybermobbing.
